Damages In A Shop Print
Written by Riviera Reporter

All you need do is say sorry…

Laura in Toulon accidentally dropped a china salad-bowl she was looking at in a shop in Marseille. The manager was “very nasty” and said Laura was “legally obliged” to pay for it. She refused and finally left the shop. Was she in her rights? Absolutely. Under French law responsibility for an object lies with whoever has it in his or her keeping (“sous sa garde”)—and articles in a shop are obviously in the retailer’s keeping. Anyway, the shop’s normal insurance would have covered the breakage. Laura did well to stand up for herself.
