Debts After Divorce Print
Written by Riviera Reporter

"Who pays?”

Hanna - who's Polish - is getting divorced from her French husband and wonders who is responsible for the debts they've contracted jointly. In principle, both ex-partners can be pursued for such debts from the moment of their legal separation. There's no way of shifting responsibility unless the creditor agrees - which is unlikely, I'd think, in most cases. However, if a debt has been formally contracted by only one of the ex-partners the law says the other is responsible for only half the amount. Of course, this is an area where serious disputes can break out and in such cases legal advice is often needed.
